Documents you will need

After the valuation, if you decide to go ahead with the sale, the certified partner will ask you for these documents. You don't need to have them all ready now, our partners can help you obtain them.

  • ID document and Portuguese tax number (NIF) for the owner, and for any co owners, if applicable
  • Certidão Permanente do Registo Predial (permanent land registry certificate)
  • Caderneta Predial Urbana (property tax record)
  • Occupancy permit, Licença de Utilização (not required for properties built before 7 August 1951)
  • Technical housing form, Ficha Técnica da Habitação (only for properties built or renovated after 30 March 2004)
  • Energy certificate
  • Proof that there is no outstanding IMI (property tax) debt
  • Mortgage discharge document, distrate, if the property has or had a mortgage
  • Declaration of no outstanding condominium fees, if the property is part of a condominium
  • Power of attorney, if you want the partner to handle everything on your behalf without you being present

Do I need to be in Portugal to sell my property?

No. With a power of attorney, the certified partner handles listing, viewings and negotiation on your behalf, without needing you to be in Portugal.

Will I pay tax on the sale, as a non resident?

Yes. Since 2023, non residents pay capital gains tax in Portugal under the same conditions as residents, with 50% of the gain subject to income tax. The final amount also depends on your country of residence, and there have been recent changes to the law in 2026 affecting those selling from abroad. Speak with one of our tax partners before deciding.

How do I receive the sale proceeds while living abroad?

In general, there's nothing preventing the transfer of the sale proceeds to your country of residence. When the buyer uses bank financing, the amount may need to pass through an account in Portugal first, usually via your legal representative, before being sent abroad. As for the tax side, including whether you'll also owe tax in your country of residence, speak with one of our tax partners, the answer varies by country.
